Who is obliged to reconcile the identification data?

The obligation to submit a proposal for the reconciliation of identification data entered in the commercial register applies to all types of companies.

The obligation to reconcile identification data only applies to companies, for which it was not possible to reconcile the data automatically by May 31st, 2022. The automated way of data reconciliation was carried out based on data entered in the register of residents, maintained by the Slovak Ministry of the Interior.

If the automated data reconciliation for all the affected persons in your company was carried out, the following symbol will appear in the commercial register under names of the registered persons: . If this symbol is displayed under the names of all registered persons, it is not necessary to submit a
proposal for the reconciliation of identification data.

However, if this symbol: , is displayed below the name of any of the registered persons, the automated reconciliation of identification data was not successful, and it is necessary to submit a proposal for their reconciliation.

Which identification data needs to be entered into commercial register?

The most commonly supplemented data is birth ID number, ID number, business registration number and an identification number of a foreign legal person. The identification data of the following persons needs to be entered into commercial register: sole shareholder / partners, authorized representatives, or members of the statutory body of a legal person, authorized representatives of structural units of legal entities and foreign legal entities, proctors, members of the supervisory body, liquidators, compulsory administration trustees and their representatives, branch chiefs.
In case that a lien on the share is established, it is also necessary to enter the identification data of the creditor and of the lien contract.

When is the deadline for the data reconciliation?

The obligation the reconcile identification data needs to be fulfilled no later than September 30th, 2022, or with the proximate motion to enter a change of record in the commercial register, whichever comes sooner.
